Application & API Terms (EULA)

This Application & API Terms section supplements the Rackset Terms of Service and governs your use of software applications, mobile apps, and APIs published by Rackset LLC, SHAMS Free Zone, UAE (“Rackset”). By installing, accessing, or using any Rackset application or API, you agree to these terms.

1. License grant

Subject to these terms, Rackset grants you a limited, non-exclusive, non-transferable, revocable license to install and use our applications for your internal business or personal use. All rights not expressly granted are reserved by Rackset.

2. Restrictions

No copying, reselling, sublicensing, renting, or redistributing the software except as expressly permitted.
No reverse engineering, decompiling, or attempting to derive source code, except to the extent this restriction is prohibited by law.
No use to build a competing product, or to circumvent security, rate limits, or usage controls.

3. API acceptable use

Use our APIs only through documented interfaces and within published rate limits; do not scrape, overload, or probe the service.
Do not use the APIs to collect data without authorization or to violate any third-party rights or applicable law.
We may throttle, suspend, or revoke API access for abuse, security risk, or breach of these terms.

4. Third-party platforms (Meta, Google, app stores)

Where an app connects to third-party platforms (e.g., Facebook, Instagram, Google), your use is also subject to those platforms’ terms, and you authorize Rackset to act on your behalf only as needed to provide the features you enable. You are responsible for holding the necessary rights and consents for content you publish through our apps. Apps distributed via Apple App Store or Google Play are additionally subject to those stores’ terms; where required, the Apple “Licensed Application End User License Agreement” minimum terms apply, and Apple/Google are third-party beneficiaries entitled to enforce this license.

5. Accounts & termination

You are responsible for safeguarding your credentials and for activity under your account. We may suspend or terminate access for breach, non-payment, or legal/security reasons. Upon termination, the license ends and you must cease use; sections that by their nature survive (IP, disclaimers, liability, governing law) continue to apply.

6. Warranty disclaimer

The applications and APIs are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, Rackset shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the applications or APIs. Our aggregate liability shall not exceed the amounts you paid to Rackset for the relevant service in the twelve (12) months preceding the claim.

8. Governing law & disputes

These terms are governed by the laws of the United Arab Emirates, as applicable to a company registered in the SHAMS Free Zone, without regard to conflict-of-laws principles. Any dispute shall be subject to the competent courts/arbitration of the applicable UAE jurisdiction.
